personal information in accordance with Quebec's Act respecting the
Protection of Personal Information in the Private Sector (Law 25) and
Canada's Personal Information Protection and Electronic Documents Act
(PIPEDA).

2. INFORMATION WE COLLECT
We collect the following personal information:
- Contact information: name, email, phone number, shipping and billing
address
- Transaction data: order history, payment information (processed by
Stripe; we do not store your credit card number)
- Communication data: messages you send through our contact form or by
- Technical data: IP address, browser type, pages visited, via cookies
and tracking pixels (subject to your consent)
3. HOW WE USE YOUR INFORMATION
We use your information to:
- Process and ship your orders
- Respond to your inquiries

6. TRANSFER OUTSIDE QUEBEC
Some of our providers store data outside Quebec, including in the United
States. Before transferring your data, we have assessed the protection
offered by each provider. By using our site, you consent to this transfer.
7. DATA RETENTION
We keep your information only as long as necessary:
- Customer accounts: for as long as your account is active, plus 3 years
- Transaction records: 7 years (Canadian tax law)
- Marketing data: until you unsubscribe
- Contact form messages: 2 years
After these periods, your data is securely destroyed or anonymized.
8. YOUR RIGHTS
Under Law 25, you have the right to:
- Access your personal information
- Correct inaccurate information
- Withdraw your consent at any time
- Request deletion of your data
- Receive your data in a structured format (portability)
- File a complaint with the Commission d'accès à l'information du Québec

9. SECURITY
We apply reasonable technical and organizational measures to protect your information. In the event of a privacy incident involving a risk of serious harm, we will notify affected individuals and the Commission d'accès à l'information as required by law.
10. MINORS
Our site is not intended for individuals under 14. We do not knowingly collect personal information from minors without parental consent.

We may update this policy from time to time. The latest version is always available on this page with an updated date.

These Terms of Service govern your use of newcastfitness.ca and any
purchase made through the site. By using this site, you accept these
terms.

2. PRICES AND PAYMENT
- All prices are in Canadian dollars (CAD) and exclude applicable taxes
(GST and QST) unless otherwise indicated
- Orders are confirmed once payment is processed through Stripe
- We reserve the right to modify prices at any time. Confirmed orders
are honored at the price at checkout
3. LEGAL WARRANTY
Under the Quebec Consumer Protection Act and the Civil Code of Québec,
all our products are covered by a legal warranty of quality. This
warranty applies regardless of any additional warranty we or any third
party may offer.
Legal warranty rights cannot be waived.
4. SHIPPING
We ship within Canada. Shipping costs and delivery times are calculated
at checkout. NewCast Fitness is not liable for delays caused by carriers.
5. RETURNS AND REFUNDS
You may return an unused product in its original packaging within 14
days of receipt for a full refund, minus return shipping costs.
Defective or damaged products will be replaced at our expense. Contact
us at [email protected] within 7 days of receipt with photos of
the damage.
This return policy is in addition to your rights under the legal
warranty described in Section 3.
6. INTELLECTUAL PROPERTY
All content on this site, including the Exoplate name, logo, photos,
text, and product designs, is the property of NewCast Fitness and is
protected by copyright and trademark law. No reproduction is permitted
without written authorization.
7. LIMITATION OF LIABILITY
To the extent permitted by law, NewCast Fitness is not liable for
indirect, incidental, or consequential damages arising from the use of
our products. Nothing in these terms limits your rights under the Quebec
Consumer Protection Act or the Civil Code of Québec.
8. EXERCISE AND INJURY DISCLAIMER
Our products are training tools. You are responsible for using them
safely, consulting a health professional before starting any training
program, and using proper form. NewCast Fitness is not liable for
injuries resulting from misuse or unsafe training practices.
9. GOVERNING LAW
These terms are governed by the laws of the Province of Quebec and the
federal laws of Canada. Any dispute is subject to the exclusive
jurisdiction of the courts of Quebec, in the judicial district of
Montreal.
10. LANGUAGE
In accordance with the Charter of the French Language, a French version
of these terms is available on our site and prevails in the event of
any inconsistency.
